Important: These Terms govern use of this website and provide baseline terms for services offered by Jacquelyn Mikus LLC, doing business as Jacquelyn Curates ("Jacquelyn Curates," "I," "me," or "my"). Custom experiences, retreats, facilitation and event-support engagements may also require a separate proposal, service agreement and, where appropriate, participant waiver. If a signed agreement conflicts with these Terms, the signed agreement controls for that booking.
1. Who may book
You must be at least 18 years old and legally able to enter a contract to book Services. A parent or legal guardian must arrange and consent to participation by a minor.
2. Inquiries are not bookings
Submitting an inquiry does not create a client relationship, reserve a date, or obligate either of us to proceed. A booking is confirmed only when the applicable agreement is accepted and any required deposit or payment is received.
3. Scope, pricing and payment
Because many Services are personalized, the scope, inclusions, dates, fees, payment schedule, third-party costs and cancellation terms will be described in writing before the booking is confirmed. Deposits may be non-refundable because they reserve time and may cover planning work or non-recoverable commitments; the specific policy for your booking will appear in your agreement.
4. Changes, cancellations and force majeure
Cancellation and rescheduling terms are set out in your booking agreement. Costs already paid or committed to third parties may be non-refundable. Weather, wildfire, public-land closures, illness, travel disruption, natural disaster, government action and other circumstances outside reasonable control may require an itinerary, location, provider, date or activity to change. When that happens, I will use reasonable efforts to offer an appropriate alternative, subject to safety, availability and non-recoverable costs.
5. Third-party providers and locations
An experience may involve independent venues, guides, practitioners, caterers, transportation providers, lodging providers, photographers or other vendors. They are separate businesses responsible for their own services, safety practices, availability and terms. Their own contracts, waivers and policies may apply. Unless expressly agreed in writing, Jacquelyn Curates does not control and is not responsible for a third party's acts, omissions, delays or cancellations.
6. Participation, outdoor activities and assumption of risk
Services may include outdoor activity in Sedona or elsewhere, walking or hiking on uneven terrain, heat, sun, altitude, changing weather, wildlife, travel, movement practices, meditation, breathwork, ceremony, cacao or other food and beverages, and reflective or emotionally evocative experiences. These activities can involve foreseeable and unforeseeable risks, including illness, injury, emotional discomfort, property loss or damage and, in rare circumstances, serious injury or death.
You remain responsible for deciding whether an activity is appropriate for you, following safety instructions, disclosing allergies, accessibility needs or health information that is reasonably relevant to safe participation, and stopping or declining any activity at any time. Where an activity presents material physical or experiential risk, a separate informed-consent and liability-waiver document may be required before participation.
7. Health and professional-services disclaimer
Jacquelyn Curates offers experiential, creative, reflective, facilitative and personal-growth services. These Services are not medical care, psychotherapy, mental-health treatment, diagnosis, legal advice, financial advice or a substitute for qualified professional care. No statement on this website should be interpreted as a promise to heal, cure or treat a condition.
8. Facilitation and personal responsibility
Facilitation may invite reflection, emotion, perspective, intention or personal choice. You retain full responsibility for your decisions, boundaries, wellbeing and actions. No particular personal, emotional, spiritual, relationship, career, health or business result is guaranteed.
9. Event + retreat support
When I support an event or retreat created by another host, my responsibilities are limited to the scope agreed in writing. Unless expressly included in that agreement, the host remains responsible for the event's program content, participant agreements and waivers, insurance, permits, venue and vendor contracts, regulatory compliance, emergency planning and overall duty of care to attendees.
10. Photos, video and testimonials
Your participation does not by itself grant Jacquelyn Curates permission to use your identifiable image, video, voice or testimonial for marketing. If I would like to use identifiable media or a testimonial, I will obtain permission through a separate release, written consent or clearly documented opt-in. Incidental crowd imagery at an event hosted by another party may be governed by that host's policy.
11. Conduct and safety
I may pause, modify or end a Service or a participant's involvement when I reasonably believe there is a safety concern, unlawful conduct, harassment, abuse, material disruption, non-payment or another serious breach of the applicable agreement. I may also modify an activity when conditions make the original plan unsafe or inappropriate.
12. Limitation of liability
To the fullest extent permitted by applicable law, Jacquelyn Mikus LLC and its owners, employees, contractors and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from this website or the Services. To the fullest extent permitted by law, aggregate liability for a claim relating to a specific paid Service will not exceed the amount paid to Jacquelyn Curates for that specific Service. Nothing in these Terms limits liability that cannot lawfully be limited.
13. Separate waivers and releases
These website Terms are not intended to replace any separate participant waiver, informed-consent form, media release, venue waiver or provider agreement that may be appropriate for a particular activity or event. You may be required to sign additional documents before participating.
14. Website content and intellectual property
Unless otherwise noted, the text, branding, photographs, graphics and other original materials on this website are owned by Jacquelyn Mikus LLC or used with permission. You may view and share links to the site for personal, non-commercial purposes, but may not reproduce, sell, adapt or commercially reuse site content without written permission.
15. Website availability and external links
I do not promise that this website will always be available, error-free or free of harmful code. Links to third-party websites are provided for convenience and do not make me responsible for those sites or their practices.
16. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Venue for disputes relating to these Terms or Services will lie in a court of competent jurisdiction in Arizona, unless a signed booking agreement provides otherwise or applicable law requires a different forum.
17. Severability; no waiver; changes
If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision once is not a waiver of the right to enforce it later. I may update these Terms prospectively by posting a revised effective date.
